Cancellation Fees

If a matter settles, vacates or cancels before a hearing has taken place and a new hearing date has not been confirmed or provided, the bundling cancellation fee is applicable.

Workspace Options

There are four options that we offer parties regarding their workspace(s) at the end of a hearing which are outlined in the table below.

Litigation specific option that is only available following interim hearings, not substantive hearings.

Electronic ArchiveArchive party specific workspace(s) for a two-year period. Workspace can be unarchived at a fee.
Applicable across all matter types following substantive hearings (or any Arbitration hearing).
Data Archiving Agreement (DAA) will be required on historic cases. DAA not required on cases if clause 5.7.2 is in proposal T&Cs. 
Matter specific as it is dependent on document count. Costs can be found in options attached to API page on Case Control. 
Deletion Permanent deletion of workspace(s).
Applicable across all matter types following substantive hearings (or any Arbitration hearing).

Separate to the above, clients can opt to have an offline export of their workspace before it is closed after a substantive hearing. The production of an offline export requires the party's workspace to remain active until the export is complete and delivered. We will need separate confirmation from the party on how we should proceed with their workspace once the export has been received/checked. 

The cost of an offline export is matter specific as it is dependent on the document count. Costs can be found in the options attached to the API page on Case Control.

An offline export does not constitute as a workspace closure option. Clients will continue to incur access fees whilst the export is conducted and after it has been sent if they do not separately confirm the workspace should be closed once the export has been checked.
